[Update: Added Brutal Legend release information and Activision compensation details]
Activision attorneys notified a court this week that they have reached a settlement with Brutal Legend developer Double Fine over the game’s release.
The details of the settlement have not yet been disclosed, but we’ve contacted both companies for comment.
In a lawsuit earlier this year Activision claimed that Double Fine had improperly transferred rights to the game owned by the publisher to its rival EA, which plans to release the Jack Black-starring title in October
In a subsequent counterclaim, Double Fine argued that Activision relinquished its rights to Brutal Legend prior to the developer signing with EA, and accused Activision of attempting to kill off a project it sees as a threat to sales of its Guitar Hero franchise.
A ruling in the case had been expected to be made yesterday, before Activision informed the court that a settlement had been reached, reports the Associated Press.
According to the LA Times, a person familiar with the settlement has confirmed that Brutal Legend will be released by EA in October. The unnamed source also suggested that Activision received little to no compensation from Double Fine and agreed to a settlement to avoid losing its case in open court.
WOOOHOOO!! Bully boy Activision gets a smack in the chops!!
A small victory!! But good to hear!! Looking forward to playing it, although a little worried that this was all a cleverly engineered marketing ploy!
Epic fail for Activision on this one.
The story has now been updated with this added info Indrema
The LA Time claims that Activision is receiving little or no compensation. The case was settled to avoid an embarrassing open-court loss.
Although an inside source claims that after the judge declined to lower the price of court fees, as Bobby requested, Activision decided to stop supporting lawsuits.
Hoo-frickin-ray.
Now what's the verdict?
